Excused Absence for Cancer Screening
Effective March 18, 2018, employees of the City of New York are entitled to take an excused absence for any type of cancer screening.
On December 17, 2017, Civil Service Law §159-b was amended to allow excused leave for all types of cancer screenings. lt had previously allowed only breast cancer screenings.
Civil Service Law § 159-c, which allowed public employees to take excused leave for prostate cancer screenings, was repealed. Prostate screenings are covered by § 159-b, as amended.
Section 159-b permits employees to take a paid leave of absence for a sufficient period of time, not to exceed four ( 4) hours on an annual basis, to undertake a screening for all types of cancer. The entire period of the leave is excused leave, not to be charged against any other leave that the employee is entitled to receive.
Please be sure to infonm employees of this new entitlement and to apply these provisions according to their effective dates. Personnel Service Bulletin 440-15 "Leave to Undertake Breast and Prostate Cancer screenings" will be revised to include further details.
